Isn't this the sort of thing that the Chevron case is going to make difficult moving forward? Can't the brands who use the unsafe additive now sue, claim it's safe, and claim the FDA is not the arbiter of the law, which doesn't explicitly permit their additive? Or am I not understanding Chevron?
