on this point I'm wondering where the line would be, thinking about that photographer who lost the copyright on the monkey selfie photo despite setting up the situation, adjusting settings on the camera beforehand, etc

So fun fact: The photographer did not, in fact, lose anything as a result of a court case. Including the copyright. That case is the source of an enormous amount of copyright mythology.

I think the decisive fact in that case (haven’t read it in a long time) was that the work itself was created inadvertently.
