Ordering this withdrawal is an official act, since the President is Commander in Chief. His motives for doing so, and in particular any connection to the recent deposit from the government of Cuba, are inadmissible. So: yes.

I know this is meant as use case for “immunity is ridiculous”, but: Hell’s bells! I’d do it for free! What does it accomplish beyond giving us a place to stash people we wish to deny due process? Better to be done with it before immunity really kicks in!
