Haven’t read the article but “Cannot foresee” is the same as “no plans”: famously Labour pre 1997 said it had “no plans to raise tax at all” but it went on to do so anyway.

I trust you're right. It will be disappointing if this is just lawyerly sophistry for "we're not rejoining the EU or the Customs Union .... because we're going to join EFTA."
