While it was illegal for Thomas Jefferson to order James Madison to withhold Marbury’s commission, the true problem was that the Constitution’s desire for a robust and energetic executive went unfulfilled by such a half measure.

If Jefferson had just ordered Madison to kill Marbury and then pardoned him for it, then his problem would’ve been solved and the courts wouldn’t have gotten involved.
