If that's the scenario, criminal liability - particularly given that the President can pardon criminal (but not civil) contempt and was already immune from prosecution while in office - was never going to be a restriant.

I don't agree with that. I think the prospect of the leader facing or not facing accountability is extremely influential on whether other people will obey him when he asks to do something illegal. "If you disobey me I will take everything from you, and if you obey me I will reward you."
