I mention this because I was teaching that course almost a decade ago in graduate school and even then, I had about a decade’s worth of material on this very issue. And still my predominantly white students pitched fits about it.

Which is to say that this kind of shit is cyclical, it is iterative, and it adjusts tactics as contexts change. Don’t believe me? There was a whole slate of these lawsuits during Bush 2: Republican Boogaloo, and I’d bet dollars to donuts they’re using precedent from that era.
