It's a death knell. This ties everything up in the courts ad infinatum. - Prosecution argues "X" isn't an official act - Appeal to SCOTUS - SCOTUS slow walks until remand or 'nahh, that sounds official to me' - Repeat as necessary until democracy dies.

They’ll just remand to lower courts to determine whether something is official or unofficial, and then only the purest drop will filter through to be decided by them.
