Yeah...
A labeler isn't an independent entity that can be sued, so if vicarious defamation liability is a thing, maybe it could happen.
I think I owe @mommunism.bsky.social a bit of an apology here. She has a point—this legal question is more complicated than I realized.

I mean- I have zero idea how it would all shake out- and I am wrong about the opinion stuff at least to a certain degree- but like… I think it could possibly be tricky

Doesn’t really need to be vicarious though; you just sue the mod that applied the label. How many eventually saw it just goes to dmgs
