Well specifically prevents criminal prosecution for official acts taken in the course of his office. He can still be prosecuted for crimes committed outside of the scope of the presidency (e.g. leading a mob to seige the capitol)

The Nixon pardon already gave de facto immunity for crimes committed in pursuit of reelection, imo this distinction is like the abortion "in case of emergency" clauses, which is to say, a fig leaf to look reasonable. Especially considering the text of the decision says the court can't judge motive
