Same way arresting someone over and over again for sleeping rough doesn't violate the 8th. The Constitution is whatever five SCOTUS justices say it is, and the people behind Project 2025 can reliably depend on six.

Heres how: you own the judges, and the judges say "obscene material isn't protected by 1A anymore". Then they start jailing whoever they want. It's easy when you own the judges.
