Nobody but congress ought be making federal laws under which a person can be subject to punishment. Per article I section 1. You want to change that, the proper road is constitutional amendment.

So Congress can never authorize another body to act? Not the IRS? Not a military draft? Really, in this modern era? Not realistic, and frankly until SCOTUS knows the difference between nitrous oxide and nitrogen suicide, not a bright idea. Expertise matters.
