Hmmm. They'd have to make that case very clearly and strongly. So it couldn't be taken as precedent.

The thing is, Republicans have no respect for precedent. They'll do whatever. If they hadn't gotten lucky on lose-the-popular-win-the-electoral-college presidents and some very well-timed justice deaths, plus McConnell stonewalling Obama's last appointment, they wouldn't have the six they have now.
