But Chevron itself was a decision to defer to the Reagan-era EPA in taking a looser approach to pollution rules; the Natural Resources Defense Council in “Chevron v. Natural Resources Defense Council” was the environmental group that *lost*.

People have obviously legit concerns and the Kagan dissent is (as usual) very persuasive but also, like, *I* am older than Chevron deference. I don’t remember the Carter administration but my sense is that it was not a demon-haunted Dark Age of judicial necromancy.

So I think Louisiana tried to make all Protestants happy by splitting graven images as a separate commandment (Reformed-style) and *also* splitting “neighbor’s house” from neighbor’s wife/servants/livestock (Lutheran-style).

But that gets you eleven commandments.

The real answer is that Catholics, Lutherans, and Calvinist-derived Protestants take different approaches on lumping or splitting the commandments on coveting your neighbor’s wife/house/ass etc. (And the Catholic Church for obvious reasons de-emphasizes the “no graven images” thing.)

I looked up the Louisiana law and went through the process of • noticing it wasn’t the Catholic enumeration of the Ten Commandments • trying to figure out which Protestant version it was • realizing it had eleven commandments.

People leap from “MLK was unpopular with the public ” to “MLK did not care about public reaction [and neither should I]” and it’s a wild misreading of King. King and the SCLC repeatedly delayed demonstrations in Birmingham because they didn’t want a backlash to help Bull Connor’s mayoral campaign.

I’ve followed this closely enough to be very confident that isn’t the case here, but also & more generally the presumption that our local protesters would consistently exercise thoughtful strategic judgment or self-policing is not at all supported by the past few years’ experience.

And most of the direct zoning and permitting barriers to creating adequate housing are at a *city* level; given the political demographics of West Coast cities that really is an intra-progressive issue. It’s unfortunate that the GOP is making hay off Kristoff’s column but the problem isn’t made up.

Maybe, but Thomas and Alito each specifically suggest here how Congress could prohibit bump stocks, either by amending the existing law to explicitly include them or by framing a law in terms of rate of fire rather than trigger function.
