Sounds like an excellent plaintive argument. I’m not a lawyer, but the defense will suggest it doesn’t matter what is ingested as long as what is produced is not identical, ie “fair use”. I think a bigger legal argument could be made over how OpenAI and others gained access to copyright material.

True - or perhaps that they store it somehow on their servers or in their programs without permission? Not entirely sure.
