Sorry, what I meant was that it seems like no one could win a nationwide election openly embracing that agenda -- that's what gives me hope. Of course, Trump (and more importantly his political appointees) will do any and all of it.

I've seen a lot of people try to connect the dots between Project 2025 and the Supreme Court's end-of-term admin law decisions. Here's how I break it down: Project 2025 is for what happens if Trump wins. The Supreme Court's decisions are for what happens if Biden wins.

It boggles my mind that with all that has transpired since 1984, one can cherry pick Chevron deference as the essential cause of congressional dysfunction. Partisan gerrymandering? Citizens United? The rise of RW media? All political footnotes apparently.

Reminder that the fisheries monitoring rule at issue in Loper Bright was issued during the Trump administration. That means it was deemed important enough to move forward despite Trump's 2-out, 1-in executive order.

new from me: I wrote about how with two decisions — repealing Chevron and granting Trump immunity — John Roberts has managed to completely rewrite the relationship between the judiciary and the other two federal branches

For scale, the Fall 2023 Reg Agenda had only 320 new regs out of 2524 in the pipeline (13%). Momentum is picking up -- not slowing down.

Some details on the Spring 2024 Reg Agenda. Of the 2361 active rulemakings listed there, 405 (17%) are appearing for the first time. And 100 of those new rules are significant/economically significant. Now *that* is how you respond to the Supreme Court. www.reginfo.gov/public/do/eA...

The Supreme Court isn't done by the way. I fully expect a reinvigorated nondelegation doctrine within the next 3 years.

Pretty cool how the Supreme Court's conservatives have spent the decades inventing gratuitous and baroque accretions for the Chevron doctrine just so they could later declare it unworkable

This is also a defining feature of Project 2025. So, you can count the Supreme Court's conservatives as accomplices in the Right's campaign to remark the United States into an authoritarian regime.

Just so we're clear: When the Trump administration sought to marginalize Project 2025 in the past, it was out of concern that it was stealing Trump's limelight, not because of any policy objections

You can always count on conservatives to turn into whiny chickenshits the second anyone holds them accountable for their shitty behavior. So it is with Trump. So it is with the conservative legal academy.

If agency regulatory flip flops were really a problem (to be clear, I don't agree that they are), it seems like there are far more elegant solutions than overturning Chevron. Beefed up Step 2 and State Farm, for example.

There was no GOP party platform in 2020, and Trump wants to shrink the proposed 2024 one. He opposes providing detail on how radical his second term will be because he knows its unpopular. Make no mistake: Project 2025 was written by Trump appointees & loyalists. Its their shared agenda.
