There was no GOP party platform in 2020, and Trump wants to shrink the proposed 2024 one. He opposes providing detail on how radical his second term will be because he knows its unpopular. Make no mistake: Project 2025 was written by Trump appointees & loyalists. Its their shared agenda.

One big question is how would these regulations be enforced? Appellate courts isn't very satisfying. How about a newly constituted committee in Congress?

To the extent that Loper Bright isn't grounded in the constitution (right?), could this hypothetical agency create regulations (through notice and comment) governing the standard of review for administrative statutory interpretation?

I keep thinking of Chevron as a "regulation" on how judges judge -- albeit one that is self-imposed. That being said, could Congress create a standalone agency charged with regulating the federal judiciary (abiding by constitutional limits, of course)?

What does Skidmore really mean when someone like Kacsmaryk is adjudicating a case? Chevron wasn't meant for the EPA or OSHA. It was meant for the Kacsmaryks of the world.

No one is saying that affirmative government actions such as regulations and enforcement should be "easy" -- Project 2025 shows why. But the import of the new legal landscape that the Supreme Court conservative majority has wrought is that such actions may now be impossible.

We've seen a similar evolution among the GOP with respect to cost-benefit analysis. The old, deregulatory GOP couldn't have found a more ideal tool than CBA for advancing its agenda. For today's GOP, cost-benefit analysis is a quaint relic. www.yalejreg.com/nc/an-analys...

But, that ain't today's GOP, which one might describe as "antiregulatory" or even nihilistic. Today's GOP rejects the legitimacy of the system, and refuses to operate within its agreed-upon framework. Chevron offers nothing to today's GOP, and *that* is why it had to go.

Chevron deference, which is truly policy neutral (as the Chevron case itself demonstrates), worked for *that* GOP. It provided them with a viable legal tool to effectively pursue their policy agenda.
