In April, the FTC banned noncompetes for all workers, finding that it is an unfair method of competition. @publicknowledge.bsky.social strongly supported the noncompete rule, as noncompetes not only harm workers, but also consumers, competition, and innovation.

Today, the U.S. District Court for the Northern District of Texas held that the FTC cannot “create substantive rules regarding unfair methods of competition” and enjoined the agency’s rule banning noncompete clauses in employment contracts for the named plaintiffs.

Courts are now free to decide what meaning of a law it likes, meaning that judges can now simply overrule agencies at their own discretion, disregarding the interpretation of the expert agency. This move could endanger important consumer protections such as #netneutrality.
