oh yes that is almost certainly why it survived. Skidmore was always a "courts can use this to justify their position if they feel like it" kind of deference.

I'm amused that there's an entire section on stare decisis though. The section should just say "The Court simply does not care about stare decisis, see, e.g., most of our decisions nowadays."

So much incorrect info going around about the Chevron decision… factual deference still applies, but judges will decide if Congress granted the agency the authority. Courts won’t be deciding how much rat poison is okay in hot dogs (yet…anyway).

those kinds of amicus briefs take away from the ones that are actually helpful. when I practiced, I was always very careful not to just repeat the parties' arguments, and I pushed others to avoid that as well. but they do anyway, and we all suffer.

one of the worst user design decisions is that Mac laptops turn on with any key press. What problem did that solve? Were laptops too hard to turn on before? It makes cleaning the keyboard very difficult.

Roku is updating their dispute resolution practices. If you want to opt out, you have to snail mail them a letter within 30 days with all sorts of product and personal info, plus a receipt. This is standard industry practice and it's really quite anti-consumer.
