Except... there is a chain of command. If the president says - hunt that man down and shoot him and the commander of the base says hand over your gun soldier... both are orders, and the soldier would be perfectly in his rights to say "Sorry Prez, no gun" - it's a mess.

This is actually an underappreciated but probably deliberate consequence of this. Creating confusion and chaos about what represents an illegal order will result in reluctant servicepeople erring on the side of "not going to Leavenworth."

I’m not interested in carefully considered scholarly opinions about why not all orders are REALLY legal now, the functional state of affairs is that all orders are legal now
