Marvel had the Changelings at the same time Beast Boy changed his name to Changeling and Marvel, DC and Image all had characters named Inferno at one point. If a character actually has a book it's a lot easier to protect their name because they can make the "confusion in the marketplace" argument.

IANAL (especially not an IP L) but as I understand it you are perfectly free to have characters with the same name; just, if the name is trademarked by someone else you can't use that name on the cover. So DC can have a character named "Captain Marvel" but nobody can address him by name on a cover.
