Getting a bit frustrating to see people on here say over and over again “why doesn’t Biden just use his new power under Trump v US to appoint 4 new SCOTUS justices and then they can fix everything?”
I don’t want to defend Trump v US, but people owe it to themselves to understand why it’s bad.
And it's not even within a president's power to do so! Expanding the Supreme Court - which has been done before and is long overdue, last done in 1869 - is solely a matter for Congress.
All of this is true but it’s also true that Biden’s unwillingness to really fight is so glaring in this context, and that’s what the (wrong) hypotheticals are speaking to

Trump v US is terrifying b/c there is no realistic path to holding a lawless president accountable. Impeachment is a dead letter and the 22nd Amendment is not viable.
The bad part is that it gives him the ability to arrest six of them, not put six new ones on the bench.
On the other hand it does give him the ability to arrest a bunch of sitting Congress members who wouldn't vote to add six more.
