People have brought up Obama drone striking Anwar al-Awlaki in 2011 as a gotcha to support the Roberts majority, but that kinda gives away the game that potentially illegal acts (i.e. assassinating a US citizen) are official acts.

Short answer: absolutely, why the fuck not? Unless you can show they are unofficial, without reference to why they are being done, under a broad and infinitely flexible standard the court won’t articulate.

A future Trump President can still be prosecuted if he declares a given action non-official, so long as he doesn’t claim his declaration of that act as non-official as itself an official act, in which case prosecutors can’t bring the non-official declaration as evidence of its being non-official.
