Ken, is there value in forcing a Constitutional crisis of some kind? While the stakes are smaller? If SCOTUS is unconstrained, and they also feel that POTUS is so, should we be testing that theory somehow? Not sure if what I am asking makes sense

This is a political question, not a legal one. A Constitutional crises would only be positive if it harmed Trump's chances of election. We arguably have a Constitutional crisis now and going forward. SCOTUS says the President is above the law.

I would like Jack Smith...in his briefing to the Judge...to point out that SCOTUS doesn't have the power to rewrite the Constitution by removing the separation of powers, checks, and balances. As such, anyone who swore an oath to the Constitution needs to rule as faithfully as possible to that doc.
