I don’t see why Merchan has to hew precisely to the SCOTUS dicta if SCOTUS doesn’t have to follow the Constitution at all. He can apply his own judgment to their dicta.

It’s very funny to me that lawyer types are saying “Merchan must interpret a discussion about Trump’s coerced bad sex as official” as if we didn’t just witness SCOTUS completely ignore the Constitution, the document they swore an oath to uphold
