Here’s something I bet many of you would agree with: I know a LOT of people who are moderate, hate Trump, are scared of Biden’s age, and simply do not believe Trump will do all the things he’s planning to do. They’ll almost all vote Biden but they don’t believe the danger is real.

I don’t see why Merchan has to hew precisely to the SCOTUS dicta if SCOTUS doesn’t have to follow the Constitution at all. He can apply his own judgment to their dicta.

I really think it’s up to Team Biden to honestly assess if he’s up to this. I’ve seen lots that make me think he is. I’ve seen at least one night that makes me think he’s not. I don’t think any of us really know. We are just projecting our desires.

When I say the Supreme Court went beyond law, I don’t mean that I disagree with their interpretation of any legal text. I mean their immunity grant isn’t based in any. The Constitution does not address it either way. They invented new powers from nothing.
