There are only two possible explanations for the abortion / EMTALA / Idaho case: 1) The conservatives on the Supreme Court are incompetent: they used an extraordinary procedure then, months later, said "oops" and withdrew it. 2) They're not incompetent; they're partisan hacks.

Today, the Supreme Court punted on Idaho and Moyle, et al. v. United States, sending the case back to the lower court to avoid making a decision before the election.

It’s long been clear that we can't depend on a Court filled with Republican operatives in robes as a democratic institution when several far-right justices regularly base their decisions on rightwing fictions and the demands of the highest bidder, making us all less safe.

This decision is a short term victory in that mifepristone will continue to remain available in the U.S. for abortion and miscarriage management for now. However, this is far from the end of the right’s attempts to strip us of our reproductive rights.

There is no legitimate reason for any court to ban or limit access to FDA-approved drugs. Mifepristone is approved for use in 96 countries, and over 100 studies have proven that it is safe and effective. 2/
