Hmm wouldn’t the courts just tell you to first raise a dispute with the Domain Name Commission? Unless they are actively using your trademark?

Why would a court do that? Trying DNC first is a good idea, but it would be strange for a court to insist on going through an arbitrary private organisation's process that you are in dispute with and have no obligations to.

Both pathways are possible. We need 2000 for an adjudication at DNC. Court pathway is also possible
