I mean it's entirely likely (I'd even say very likely) that hate crime laws in the Netherlands simply might not apply to crimes against property, regardless of motive. They might HAVE to be crimes against persons.

Eh this doesn't sound political. Sounds like a pretty technical reason why ERISA isn't applicable. Judge even flagged that they could refile without the ERISA etc.

Yes, a hate crime depends on motive. And if the motive for defacing the statute was because its subject was Jewish then, depending on relevant applicable statutes of course, it could absolutely be a hate crime.

Yeah at 13 justices I'd say a panel of a majority, so 7. Though I'd also say that you want to make sure there's a relatively even distribution of cases amongst all the justices. So that the Chief can't just give his cronies all the "big" cases

Antisemitism does have so special peculiarities above it that are a little different from other forms of hate. The "world controlling globalist conspiracy" narrative is pretty specific. Often finds other forms of hate tracing back to it (i.e. "blacks are violent because the Jews manipulate them").
