New: The U.S. Sentencing Commission today voted in favor of curtailing the ability of federal judges to impose longer sentences on criminal defendants based on conduct for which they were acquitted at trial.

Both of these dynamics are examples of reasons we suggested that the Judicial Conf. consider amending the Federal Rules of Civil Procedure, not just issuing guidance. But! The option to amend the rules remains open if the guidance doesn't produce the results we all hope for. /5

In a remarkable letter, Sens. McConnell, Tillis and Cornyn urged courts to ignore the Judicial Conference's guidance - so there is certainly reason to worry that the policy won't have the effect the Judicial Conference is anticipating. reuters.com/legal/us-sen... /4

One question is how the various chief judges of the 94 federal districts around the country interpret the guidance. The Judicial Conf. said they want to give those judges the flexibility to address the problem - so, will they follow through?wapo.st/4ajhvmj (gift link) /2
