As a lawyer, I understand the reasoning, but— You know how companies put arbitration clauses in their Ts&Cs, prohibiting class actions? About 35,000 Samsung customers filed individual arbitrations. Samsung refused to pay its share of the AAA fees, so the cases were dismissed. 7th Cir: no problem.

As @akivamcohen.bsky.social can attest, this happens in employment as well as consumer arbitration:
1. Company bans class actions
2. Many individuals bring cases, creating headaches company would have avoided with a class action
3. Company says: "we didn't mean it like THAT"
