If I could go back to law school & devote myself to Fed Soc and law review rather than the Homeless Outreach Project and the Women's Law Journal, then clerk for Fed Soc judges rather than those I did clerk for, my life would be SO easy now. I'd just have to stash a portrait in the attic first.

The actual direct effect is to fuck up the Trump prosecutions. That's bad, but unless it's the factor that causes him to win the election, the damage to the country is limited. I don't think POTUSes have restrained themselves for fear of prosecution, so it's hard to say immunity will change much.

This decision is awful. But its awfulness is mostly because of principle & symbolism & what the kids call "vibes" rather than direct practical effects. It's what it will encourage Trump to do, rather than what, strictly speaking, it allows him to do, that worries me.

My mom's parents were German Jews who left their country in 1938 and 1939. The story on Dad's side isn't as harrowing, but it's still dramatic. I'll survive. But I am worried about a lot of other people who are much more vulnerable than I. Oh, for a boring election between two beige centrists!

Another fun fact: Missouri SG Divine, who signed this bullshit, clerked for Clarence Thomas & Bill Pryor. He's in line for an 8th Circuit appointment if Trump wins. The Texas SG, an ex-Alito clerk, refused to sign the 2020 election lolsuit. Divine had a choice. Senate Judiciary Dems, take note.

BTW, don't freak out when Alito & Thomas dissent from the order dismissing this case. Even they don't believe it's got any merit, & they wouldn't actually vote for Missouri to win. It'll look like the order when the Court dismissed Texas's attempt to overturn the 2020 election..

I hope St. Vincent quickly gets the help it needs. I represented Grenada in a few cases. It had been about five years since they'd been hit by Hurricane Ivan, and the economy and infrastructure were still showing the signs. Small states can't have a FEMA standing by—we have a responsibility.

Fun fact: When a state files a case against another state, invoking SCOTUS's original jurisdiction, the pleading it lodges is not called a "complaint," as in a district court case. Instead, it's called a "application for a federal job or judicial appointment for our AG if you win the election"

You left out the part where all this happens before sentencing b/c Trump asks for a stay of proceedings & keeps appealing the denial of a stay until SCOTUS grants one and sets briefing on the merits for "not earlier than the next time a Canadian team wins the Stanley Cup."

I've posted that Trump's sentencing might be stayed & ultimately never happen This isn't it. This is the Missouri AG's bid for a job in Trump's DOJ. BTW: Thomas & Alito will dissent from the Court's dismissal; they do that in every State v. State case; it won't mean anything.

The consumers had the option of paying Samsung's share. But costs include the arbitrators' fees, which will average tens of thousands of dollars (at least) for each consumer-claimant. Samsung's approach defines bad faith: YOU can't go to court, but Samsung retains the option of court or arbitration.

Samsung's non-payment tactic is loathsome. One thing companies CAN'T do in forced arbitration clauses is adopt rules requiring the cliamant to pay all the costs of the arbitration. By adopting a policy of not paying its share—resulting in dismissal of the arbitration—Samsung is doing exactly that.

1. Company bans class actions
2. Many individuals bring cases, creating headaches company would have avoided with a class action
3. Company says: "we didn't mean it like THAT"

As a lawyer, I understand the reasoning, but— You know how companies put arbitration clauses in their Ts&Cs, prohibiting class actions? About 35,000 Samsung customers filed individual arbitrations. Samsung refused to pay its share of the AAA fees, so the cases were dismissed. 7th Cir: no problem.

Reminds me of Scalia. Part of his originalism was insisting that an act be described as specifically as possible. When you do that, it’s usually obvious that there’s no history of believing there’s a protected right to engage in that act. I think we’ll see the opposite approach with “official act.”
