Then the judge is legitimate to the extent they embody the collective social notion of fairness, and the Law is defined by how the legitimate judges make judgements, not the other way around.

Better than nothing! Works most of the time and useful guidelines for the rest! So we are left with the Judge who for fairness must at times throw cards for “unsportsmanlike conduct”. ... ->

But the job of the Judiciary is to decide cases one at a time and it will be "legitimate" if people in general think results are generally fair. The text of the Law (ideally) attempts to model fairness, but it can never do so accurately enough to discriminate and eliminate malign trimmers ... ->

Running "vagrants" off is at least original Originalism. The through line in our more compassionate era will be to have a nice enclosure somewhere out of town where people who commit homelessness can pitch their tent in tranquility. But I suppose some bleeding-hearts will just complain about "food"
