You're an academic w multiple job offers. Do you take the offer from UofC or UofA or the offer from a U that doesn't labour under Bill 18 & doesn't send in police in full riot gear a few hrs after tents are set up. Simplistic perhaps; no yes or no, but it will be a relevant consideration

The SCC’s decision on Quebec’s Reference of the federal Indigenous Youth and Family Act turned out to be a federalism decision focused on the ‘Indians’ head of s 91(24). This post is a thought experiment on the implications of the decision for the 'lands reserved' head of 91(24).

Here's my post with @molszyns.bsky.social arguing that until all the new rules (and there's a lot of them) are actually in place, the uncertainty will be such that there is effectively a continuing moratorium on new renewable projects in AB.
Perhaps that is just what Premier Smith hopes for.

Last week the Federal Court handed down its judicial review decision in a case involving the dead Grassy Mtn project, Benga Mining and two First Nations: 2024 FC 231 (CanLII), <canlii.ca/t/k2sbk>  This post aims to put this FC decision in the context of Benga’s overall litigation strategy.

The NZSC reversed the Court of Appeal’s decision that had struck out the claims on the basis that they were bound to fail. The NZSC has reinstated all the claims which will now proceed to trial. The Court also accepts that Māori traditional law (tikanga) may be relevant to the claims.

DanielleSmith's speech last night was a version of "Please God, give me another boom & I promise I won't piss it away this time." Two problems: (1) what if there is no continuing boom, & (2) AB conservatives can't resist robbing the next generation of resource revenues to keep their own taxes low.

Danielle Smith is going to be pissed off about that. In January she and the UCP said they wanted a law that the province would act as a go-between between municipalities and the federal government because she wants to control everything.

Israel has publicly insisted upon the evacuation of civilian non-combatants from Rafah while operating militarily in a manner that does not recognize any difference between combatant and non-combatant, treating all Palestinians as "fair game", and even blockading movement in and out of Rafah.

The Federal Court has dismissed Benga's JR application re the Grassy Mountain Project, but also concluded that Canada breached legitimate expectations owed to the Piikani and Stoney-Nakoda Nations. Matter referred back to the Minister for redetermination following the required consultation. [204]

South Africa has asked the ICJ to order additional provisional measures to forestall the IDF's forced evacuation of 1.4 million people from Rafah (normal pop 280,000). The application is here: icj-cij.org/sites/defaul... Canada needs to support this application and stop the mayhem.

In light of this finding Canada can no longer say that it does not "accept the premise of the case brought by South Africa". Minister Joly's shameful statement is inconsistent with Canada's commitment to the international rule of law. 2/

I have always thought that the real test of a government is this: CAN YOU KEEP THE LIGHTS ON AND LIVING SPACES WARM? And if not, and especially if you're not even in the jurisdiction to address the issue Premier Smith, then it's time you moved on.

Alberta's system operator identified the need to build storage 🔋 years ago and the government even passed a bill – but stopped short of proclaiming it. More storage will continue to be useful for days like today. Our outdated regulations are holding back lowest-cost solutions.
