This - Thomas and Alito will dissent from the order dismissing Missouri v. New York because they don't believe that SCOTUS has the authority to decline to hear state-versus-state cases. They do in every such case, regardless of what the case is about.

I think they’re correct, by the way. They can dismiss under 12(b)(6)-type standard but i think the Supreme Court is obligated to consider the merits of a state vs state suit
