Did anyone ever claim that the Constitution *required* DOJ independence? Keeping hands off DOJ has only ever been a choice that Presidents usually made (for good reason). But Constitutionally, the DOJ is no more “independent” of Presidential control than the departments of Defense or Education are.

I mean norms and institutions matter. When you give someone absolute immunity you are pretty much saying "forget those norms if you like."
