Yes, but to what end is he Commander in Chief? Imagine the president would order the military to just randomly kill everyone who votes for the Democrats. Would this be them using a core executive power? Of course not.

Using the military and giving them orders is inarguably a core power. This decision cripples any evidence to prosecute him even if somehow DOJ wanted to, and he can stop the DOJ. Prosecuting officers and the soldiers, would be his military courts. And pardons. You can't enforce norms.

Of course not? That’s an awful lot of confidence with no masks in reality. The Republican Supreme Court is making this up as it goes along. The law is what they say the law is, not what you or the constitution say it is.
