That happened because he commercialized it, and sought to sell it as an authorized sequel, not as fanfic. Fanfic is only covered by "fair use" as long as it fits some specific tests. One is it being non-commercial. There are *thousands* of LOTR fanfics. The estate only went after this one.

This case, which I'm familiar with, is a bit more complicated and falls squarely under "play stupid games, win stupid prizes." The fanwriter wrote Tolkien fanfic but then tried to claim ownership of actual Tolkien works.
