Best SEC of my lifetime easily and they keep getting struck down by any ad hoc rationale the Fifth Circuit can cook up. But it does make adjudication easier. No need for learned and complex academic studies to submit—just who’s got more cash.

Not just any moneyed interests—it rewards fraud and corrupt practices time and again. 87% of the past decade cases in fraud with public firms when through AlJs—now gone because we need to hold to common law ideas about frauds that couldn’t exist since these financial instruments didn’t.

In 1981 Ann Gorsuch said, "The EPA will defer to Chevron" and in 1984 SCOTUS said, "The courts will defer to EPA's deference to Chevron." But Dems took over EPA, and Neil G. whined, "EPA isn't deferring to Chevron the way mommy used to," so his court bros took pity and killed deference to EPA.
