For Green Central Banking, I wrote about the US’s progress (or lack thereof) addressing climate risk.

I urge the US to take a leading, rather than obstructionist, role in the international effort to grapple with the financial implications of climate change.

Most of the largest banks are national banks, not state chartered. The large banks under NYDFS are generally either subs/branches of foreign banks or subs of the investment banks that converted in ‘08. Plenty of lenders not covered. (Not commenting on whether they’d want to lend to this customer.)

Grateful to the members of the George Mason Law Review for publishing my new article, "Major Questions' Quiet Crisis," about how the major questions doctrine could change banking regulation and put the financial system at risk.

FYI, I have an article on the major questions doctrine that discusses banking agency deference, including some of the OCC & Fed activities cases. One of my arguments is that industry may not like some of the results of rolling back deference in agency rulemaking.

For those interested, on Thursday morning I’ll be visiting (virtually) my alma mater GW Law for a conversation with my friend and colleague Bharat Ramamurti on the Biden Administration and Treasury Department’s economic policy agenda.

There’s an old ‘This American Life’ episode about money in politics that includes a discussion of “call time” that’s pretty good.

Today, I discussed the use of AI in financial services, including consumer finance & insurance.

Potential risks fall into 3 categories: (1) risks arising from the design of AI; (2) risks arising from how humans use or deploy AI; (3) operational and cyber risks.
