The Court's ruling in the Alabama gerrymandering case last year is instructive: The Court struck down obviously-illegal maps. BUT FIRST it issued an injunction keeping them in place for the 2022 mid-terms, handing Republicans control of Congress using illegal maps. Process matters.

While I'm on the timeline point, I will note that it has always struck me as somewhat likely that SCOTUS deals with 14th amendment case by punting on the merits and saying "it's too close to the election to kick him off the ballot" & every day that goes by makes that more likely.

It's the most important principle of american election law: If someone gets caught cheating in an election, you have to first give them the benefits of cheating, then ask them politely not to cheat in the next election.
