i personally do not think the court should have this much discretion over the timing of its decisions.

On my first jury, we let someone off due to lack of evidence. After the verdict, we learned it was a repeat crime and that a wealth of evidence around the first offense was not admissible because court logistics (possibly manipulated) caused the second case to be brought to trial before the first.

i don't think they should have discretion over what they have for lunch at this point they should have to live in a cloistered sanctuary away from the temptations of the world

I would have stopped that post at "I personally do not think the court should have this much discretion."

They are obviously run off their feet. I understand they even reject cases. Shouldn't they appoint a few more to help out. asap 😀

Seriously, all these cases are decided. There should be a "can't make a decision by date X, the lower court's opinion is automatically affirmed. All decisions are released on date X"

It could issue the remaining decisions in 2026 and that would violate only custom. 🤷‍♂️ They are a government unto their own.

Any sentence that begins with "The court shouldn't have this much discretion over" is almost certainly true no matter how it ends

I think it's apparent a LOT more control of what goes on in that little precious star chamber needs to be yanked out of the hands of those in it. They are NOT the 'final word' of our government. They need to feel like employees and servants of we the people, not little lordlings.

most discussions of court reform focus on the high level stuff — size of the court, extent of its jurisdiction — but i think the low level stuff like the extent of the court's discretion in choosing and deciding cases is just as important.

They should get all the cases, toss it in a bingo machine and order the date of the decisions in advance. The immunity decision being held this long has to be political. But, they are able to politic from the bench with no consequences.

it's almost like the supreme court should have a bunch of rules on things like timing, not taking bribes, not calling for the overthrow of the US government, mandatory recusals, etc. Seems like in a well functioning system they would

At first I thought they were delaying the immunity decision as some form of horse trading. Roberts scrounging for some of his beloved legitimacy and the price for someone on the conservative bench was timing. Now I fear the decision is pure awful, and they’re delaying it just to show they can.

The court holding back its presidential immunity opinion feels like it runs afoul of the sixth amendment's right to a speedy trial.

State courts in CA have to make decisions within 90 days or they don't get paid. It is absolutely ridiculous that they can drag these out for so long. No reason the supposed best legal minds in the country, with the best legal clerks, can't decide these cases. Should start a lazy meme.

i think you can see it as analogous to their refusal to give any forward guidance or legal advice to the other branches outside of their decisions the sense that they just aren't accountable to anyone else. we just have to put up with their arbitrary choices.

Well, at least bribery is now legal for state, local, and tribal elected officials under certain circumstances and so long as you call it a gratuity, so we have that going for us, which is nice.
