Doesn't the POTUS just go to OLC and ask for an opinion that X is an official act? Yes, assuming OLC is trying to do their job, they say honestly, no, doing a coup is not an official act. But if POTUS has stacked the office, they say yes.

The problem is that "official acts" will become whatever the right wing majority on the Supreme Court likes. Anything they dislike will suddenly become "unofficial acts."

couple of observations from reading the decision: 1. this is really bad. 2. in practice, the status quo has also been bad, and i'm honestly unsure how much of a departure this is from the status quo. i'm still mad about the lack of accountability for Nixon, George W. Bush etc. ...
