i wrote a bit about Brown on May 24, around the anniversary, which might be helpful. notably, Eisenhower's defense of it was about rule of law, not morals and civil rights. But Southern victimhood and federalism provided a broader ideological framework for Brown resistance.

i'm not sure a president has ever said that (but haven't done a keyword search). W criticized courts for being unelected and approving same-sex marriage; Obama criticized Citizens United; FDR obviously fought with the court over the New Deal. this is a weird prez power case...

roberts’ reasoning is fundamentally (lower-case “r”) anti-republican. i know we dunk on the framers here but roberts has issued a rebuke of the revolutionary assumption that concentrated, unaccountable power is a fundamental threat to liberty.

in practice, presidents have been enjoying a lot of immunity. This codifies it in a way that's quite alarming in the abstract, but even more alarming in the case considered. The decision references Trump's discussions with Pence about trying to interfere with the EC vote counting as "official"

couple of observations from reading the decision: 1. this is really bad. 2. in practice, the status quo has also been bad, and i'm honestly unsure how much of a departure this is from the status quo. i'm still mad about the lack of accountability for Nixon, George W. Bush etc. ...

If the lower court understood the present moment, this would be its response: "The court is surprised this needs to be said, but anything related to a coup attempt is not an official act. That includes all of the conduct in the indictment. Trial begins September 1st."

I don't want some egghead bureaucrat telling me whether there's poison in the water I drink. Ideally I'd want that decided by a 29yo judge who went to a "biblical law school" and does not believe dinosaurs existed, and then to have that decision reaffirmed six years later by the Supreme Court.

i recommend a fun hobby. we're all so scarred from 2016. i think at a certain point, news consumption takes us into the headspace of seeing the election result as written in the stars. fact is there's lots to do to improve our society (not that i'm sure writing my book or knitting is really that)

i knit, read novels, exercise, and spend time with people who don't live and breathe this stuff. i don't see how we survive otherwise. frankly, 2020 was so so dark because i had so little else to do.
