I think she dislikes every kind of toll on cars and has not really been honest about her views on the policy, and also is very sensitive about the House elections screwup in NY, and also is sensitive about Cuomo. I just think she’s never liked it and wanted to kill it.

I am not a lawyer. But the overwhelming impression one gets is that the GOP judges will both believe and push the envelope on these, and the Dem judges will defer to the brain worms out of a misguided obsession with institutionalism. See eg Katyal endorsing right wing nominees.

I do not think being unclear about how much subsidy they get is helpful either. They are the welfare queens of America. And I don’t have any issue with people pointing that out and changing those policies. But of course the policies can’t be changed because they can’t survive.
