He's also using it for crimes he commited after he was president too, so I don't think he thinks the exact timing of the crimes matters, just as long as he remains immune to any and all consequences for all his actions.

Their argument is that the prosecution partially relied on things he did while president as evidence, and that might now be inadmissible due to Trump v. U.S.
