My theory is that they were more concerned about the Jan. 6 prosecution, but the NY conviction almost certainly prompted some last-minute additions to the opinion.

That's probably right. I just think they need to appear to have at least a veneer of law over their exercise of power and swooping in to rescue Trump in his capacity as a private citizen rather than as a president doesn't allow for that.
