The whole point of reaching the conclusion the majority did is that they - Roberts in particular - very much believe prosecuting Trump for insurrection would have made a difference in the election.

That's to be expected, but it's really disheartening to see people like Quinta, Rick Hasen and Steve Vladeck *also* refusing to acknowledge why Roberts did this. If non-conservative legal pundits and academics don't get it, they're not going to be able to help the public get it.

Yes it does. It makes perfect sense when you realize Roberts wants the Republican candidate for President to win the election. Trump being convicted of serious felonies would have imperiled that outcome, so you get this.

none of this matters. he wants a republican to win and a democrat to lose. he wrote the immunity opinion because trump is currently the republican nominee and he wants him to be the next president. you don't have to overthink this. roberts certainly didn't.

Maybe I am jaded, but I don't for a second believe that Merchan - who couldn't even hold Trump in contempt for conduct that would have landed anyone else a night in jail - intends to sentence a presidential candidate 7 weeks before the election.

Rick Hasen is a good example: Roberts implies in the majority opinion that he ruled out of concern for future hypothetical conflicts re: executive authority. But it's pretty obvious he's actually not! And legal academics should be able to say so!

Everything Barrett does makes a lot more sense when viewed within the context that she is a woman in a male-centric movement. She is genuinely smarter than her male colleagues on the Court, and she knows the liberal press and academics will point that out if she gives them the opportunity.
