if the court follows normal crim law, will depend on how the mass of the court looks at it under harmless error analysis. the main hook provided by yesterday’s decision will be evidentiary rulings - to allow evidence from trump’s time in office. Not typically fatal to conviction

i am a lawyer with extensive experience in the area, and there’s certainly academic debate, reflected in the law rev article, but no legal debate. the law has had no interest in the debate. the law is pretty straightforward and consistent (there’s a diminished to no expectation of privacy)
