i’ll admit i thought he had the juice for the campaign until the debate, because he pulled it together every time he needed to. Every debate, every state of the union, etc. was always prefaced by people saying Biden didn’t have it and being proven wrong. but they were bound to be right eventually.

in 2020 “Biden is too old” was a big narrative going into the first debate with Trump, but he performed well and shut the concerns down. Ever since then, concerns about his age have had a boy who cried wolf element to them, and i think that’s part of why so many people were caught off guard.

right. the narrow version is something like: Roberts held that the direction of the DOJ is a core power, as are communications with executive branch members about official business. Everything else is theoretically in the air.

there’s a narrow reading where it’s untouched: The Court says there’s immunity if the President is acting within his powers, and Youngstown reflects a limit on those powers. in practice I don’t know how you square Roberts’ articulation of executive power with Youngstown.

I know this is tongue in cheek, but the point is that the limitation is the scope of the office as the Court sees it. within that scope, it’s open season. so under the majority’s logic, for example, there’s really no limit to what the president could use the military for.

the simple way to think about it is that the office of the presidency is a gun. the Court has held that when you become the President, you have an unfettered right to use that gun any way you please. an insane decision.

reflecting on the immunity decision a bit, what the Court seems to be saying is that every element of the executive branch is at the President’s disposal, no matter what he wants to use it for. his motives don’t matter. the office is a weapon to be wielded however he sees fit.

i'm not the first to say this, but this is very similar to the "generic democrat" effect (in polling, an unnamed democrat or republican will often do better than actual politicians because there's no associated baggage). people are hyped on "someone else" but not on anyone in particular.

San Francisco politicians, for instance, made a big stink of this. “The 9th Circuit is saying we have to let homeless people camp in public!” But that was never true, they were only saying you have to provide the people you displace with a place to sleep. A pretty basic requirement!

the 9th Circuit never said that you can’t, e.g., bust up homeless encampments. They just said that before you do, you need to provide shelter beds, otherwise you’re just being punitive and cruel. An extremely basic a call for decency, but many West Coast city leaders were outraged
